Maritime Accident & Injury Cases We Handle
Leah Wise Law Firm takes on a wide range of maritime and offshore accident cases, including:
- The Jones Act: Under the Jones Act,a seaman injured on the job has the right to file claims and obtain compensation for the damages resulting from the negligence of a vessel owner, captain or other member of a vessel’s crew, or the unseaworthiness of a vessel.
- The Death on the High Seas Act: The Death on the High Seas Act (DOHSA) applies to the survivors of individuals killed in vessel and aviation accidents on the high seas. Under DOHSA, the surviving family members of seamen who were killed by the negligent acts of an employer, ship owner, or crew member while serving on a U.S. vessel sailing at least three nautical miles off the coast of the U.S and its territories has the right to seek compensation for their loss.
- The Longshore and Harbor Workers’ Compensation Act: This federal law provides protection to workers who have suffered on-the-job injuries while working in support of the maritime industry on the navigable waters of the U.S, or in adjoining areas used in the loading, unloading, repairing, or building of a vessel.
- The Outer Continental Shelf Lands Act: While this law provides many of the same benefits as the Longshore and Harbor Workers’ Compensation Act, it specifically applies to maritime employees working on the Outer Continental Shelf who are not covered by the Jones Act.
What Is Maritime Law?
The laws that apply to workers in land-based jobs were not adequate for their water-based counterparts. Maritime law was created to outline the specific rights of ocean-based personnel and provide them extra protection as maritime workers.
Maritime law, also called admiralty law, governs activities and incidents that occur on a body of water. Maritime law covers a variety of categories, including legal job duties, marine shipping, cargo damage, stipulations of maritime injury claims, and more.
Maritime law is a complex and specialized field, which is why you should consult with a knowledgeable and experienced attorney who can help you understand all of your legal options so you can make informed decisions.
