Under Texas law, the following parties can file a wrongful death claim:
- Spouse of the deceased
- Children of the deceased, including legally adopted children
- Parents of the deceased, including adoptive parents
If none of the above parties file a wrongful death claim within 3 months of death, an executor of the estate may be allowed to file a claim.
Families may file jointly as a group, or an individual family member can file on their behalf. In Texas, siblings and grandparents of the deceased are not eligible to file a claim.
